1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of Smart Lending’s website, online applications, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.

2. Eligibility

You may only use the Services if you meet all the following criteria:

  • You are at least 18 years old (or the age of majority in your state of residence);
  • You are a legal resident of the United States; and
  • You have the legal capacity to enter into a binding agreement.

3. Nature of Services

Smart Lending is not a lender. We operate as a loan marketplace and technology platform that connects consumers with third-party lenders and financial service providers. All loan offers, terms, and approvals are provided by third-party lenders and are subject to their independent review and approval criteria.

We do not guarantee:

  • That you will be approved for a loan;
  • That any loan terms or rates offered to you will meet your needs; or
  • That any offer is the best or only option available to you.

4. No Guarantee of Approval

Submitting your information through our Services does not guarantee that you will:

  • Receive a loan offer;
  • Qualify for a loan; or
  • Receive specific loan terms.

Third-party lenders may require additional information to determine your eligibility.

5. Credit Authorization

By submitting your information through our Services, you:

  • Authorize Smart Lending, our lending partners, and our technology service providers to obtain your consumer credit report and related information from one or more consumer reporting agencies to evaluate your eligibility for credit products.
  • Understand and agree that this request will result in a soft credit inquiry only, which will not affect your credit score.
  • Authorize the use of your credit and personal information to verify your identity, determine your eligibility for loan products, and present potential offers.

6. Communications Consent

By providing your contact information, you provide your express written consent for Smart Lending and our lending partners to contact you by:

  • Telephone calls, including calls made using an automatic telephone dialing system and/or prerecorded/artificial voice messages;
  • SMS/text messages (message and data rates may apply);
  • Email; and
  • Postal mail.

These communications may relate to your inquiry, application, account, or related products and services. Consent is not a condition of credit or purchase.
You may revoke your consent at any time by:

  • Replying “STOP” to any text message;
  • Clicking the “unsubscribe” link in any email; or
  • Contacting us directly.

7. Electronic Communications & e-Sign Consent

By using our Services, you agree to receive all required disclosures, notices, agreements, and other communications electronically. You also agree that your electronic consent — including clicking a checkbox, typing your name, or providing a digital signature — has the same legal effect as a handwritten signature.

You may withdraw your consent to receive electronic communications at any time by contacting us. Withdrawal of consent may limit our ability to provide the Services.

Smart Lending expressly disclaims any and all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free;
  • Any loan offers will meet your requirements or expectations.

12. Limitation of Liability

To the maximum extent permitted by law, Smart Lending, our affiliates, and our respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of the Services.

13. Indemnification

You agree to indemnify, defend, and hold harmless Smart Lending, our affiliates, and our respective officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the Services;
  • Your violation of these Terms; or
  • Your violation of any applicable law or third-party rights.

14. Arbitration Agreement & Waiver of Jury Trial

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • The arbitration will take place in your county of residence.
  • You waive any right to participate in a class action, class arbitration, or similar representative proceeding.
  • You may opt out of arbitration by sending written notice within 30 days of accepting these Terms to:

15. State-Specific Notices

  • California Residents – You have additional rights under the CCPA/CPRA. Please see our Privacy Policy for details.
  • Vermont Residents – We will not share your credit information with nonaffiliated third parties without your consent.
  • Nevada Residents – You may be placed on our internal “Do Not Call” list by contacting us at 866-214-0004.
  • Colorado, Connecticut, Virginia, and Utah Residents – You have privacy rights under your state’s consumer privacy laws. Please see our Privacy Policy for details.

16. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will post the updated Terms on our website and update the “Effective Date” above. Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms.
